Heavy Welding Specialists Pty Ltd is committed to providing clear and consistent terms for the goods and services we supply.

Our Standard Terms of Engagement govern the provision of goods and services by Heavy Welding Specialists Pty Ltd ABN 36 665 705 313 (HWS) to our customers.

About Our Standard Terms of Engagement

Our Standard Terms of Engagement, together with the relevant quotation or proposal, Work Order and Schedule of Rates, form the Contract between HWS and the Customer.

By issuing or accepting a Work Order, or by directing HWS to commence the Works, the Customer agrees to be bound by these terms.

Quotations, Orders and Customer Terms

HWS Standard Terms of Engagement apply to our quotations, proposals and Work Orders.

Where a Customer provides its own purchase order, tender conditions or other terms, the HWS Standard Terms of Engagement prevail unless HWS expressly agrees otherwise in writing.

Payment and Credit

Our Standard Terms of Engagement set out HWS’s requirements relating to invoicing, payment, late payment, suspension of Works, debt recovery, title in materials and goods, credit applications and security.

Where applicable, HWS may require a completed credit application and a personal guarantee and indemnity from one or more directors before providing credit or commencing Works.

Works and Site Requirements

The Terms also cover matters including:

• Standard of Works
• Site access and pre-commencement requirements
• Care of the Works and risk
• Variations
• Programming and delays
• Defects and warranties
• Site health and safety
• Insurance and indemnities
• Suspension and termination Dispute resolution

Director’s Guarantee and Indemnity

Where required by HWS, directors or other guarantors may be required to enter into a Director’s Guarantee and Indemnity in connection with a Customer’s credit account or obligations to HWS.
